Chinese boat detained after fishing in Japanese waters

Tokyo, (IANS) The Japanese Coast Guard has detained a Chinese fishing boat for allegedly fishing in the country?s exclusive economic zone without authorisation, Xinhua reported Sunday.

The Chinese consulate general in Fukuoka said the boat, which belongs to Fujian province, was seized around 10 p.m. Saturday near Japan?s Kagoshima prefecture with its captain and eight crew members on board.

All the crew members are Chinese nationals, the consulate general said.

The captain, who admitted that his boat had entered Japanese waters, and two crew members have been taken for questioning.

China has asked Japan to ensure the safety and legitimate rights of the sailors.

Those camping overnight, especially children and seniors, should dress in thick layers to guard against the cold. Pets, officials said, are not advised to be included if they are frightened by sudden, loud noises.

And spectators who bring a small grill must make sure it is at least a foot off the ground and kept 25 feet away from buildings and other combustibles. Be sure to have a fire extinguisher and water on hand.

In case of emergency, officials said to call (626) 744-4241 from a cellphone or 911 from a land line and be prepared to give a location.

The 124th Rose Parade ? this year's theme: "Oh, the Places You'll Go!" ? will begin at 8 a.m. Tuesday at Green Street and Orange Grove Boulevard, continue for two hours at a 2.5-mph pace onto Colorado Boulevard for the longest stretch, and end at Sierra Madre Boulevard and Villa Street.

The weather is expected to be partly cloudy and chilly, with a low of 43 degrees the night before the parade, according to a National Weather Service forecast. That's expected to give way to sunny skies and a high of 60 Tuesday.

3 injured in oil facility fire in Montana

WIBAUX, Mont. (AP) ? A fire at an eastern Montana oil slop recycling facility that injured three workers is being allowed to burn because of the danger of more explosions.

Wibaux County Disaster and Emergency Services spokesman Mike Schneider said Sunday he and fire crews are watching the fire from about a quarter mile away. The facility near the Montana-North Dakota state line is at the edge of the Bakken crude patch.

He says the fire started Saturday afternoon at a Custom Carbon Processing facility and is limited to the trailer of a tanker truck and a large, three-sided structure that has been destroyed.

He says the fire started with a flash explosion as the truck's operator was pumping the trailer's flammable contents into the structure where the three workers were putting in insulation.

Schneider says the three workers needed medical attention but it's unclear how badly they were burned.

(AP) ? Pakistan's leading arts college has pushed boundaries before in this conservative nation. But when a series of paintings depicting Muslim clerics in scenes with strong homosexual overtones sparked an uproar and threats of violence by Islamic extremists, it was too much.

Officials at the National College of Arts in the eastern city of Lahore shut down its academic journal, which published the paintings, pulled all its issues out of bookstores and dissolved its editorial board. Still, a court is currently considering whether the paintings' artist, the journal's board and the school's head can be charged with blasphemy.

The college's decision to cave to Islamist pressure underscores how space for progressive thought is shrinking in Pakistan as hardline interpretations of Islam gain ground. It was also a marked change for an institution that has long been one of the leading defenders of liberal views in the country.

Pakistan is an overwhelmingly Muslim nation, and the majority of its citizens have long been fairly conservative. But what has grown more pronounced in recent years is the power of religious hardliners to enforce their views on members of the population who disagree, often with the threat of violence.

The government is caught up in a war against a domestic Taliban insurgency and often seems powerless to protect its citizens. At other times it has acquiesced to hardline demands because of fear, political gain or a convergence of beliefs.

"Now you have gun-toting people out there on the streets," said Saleema Hashmi, a former head of arts college. "You don't know who will kill you. You know no one is there to protect you."

The uproar was sparked when the college's Journal of Contemporary Art and Culture over the summer published pictures of a series of paintings by artist Muhammad Ali.

Particularly infuriating to conservatives were two works that they said insulted Islam by mixing images of Muslim clerics with suggestions of homosexuality, which is deeply taboo in Pakistan.

One titled "Call for Prayer" shows a cleric and a shirtless young boy sitting beside each other on a cot. The cleric fingers rosary beads as he gazes at the boy, who seductively stretches backward with his hands clasped behind his head.

Mumtaz Mangat, a lawyer who petitioned the courts to impose blasphemy charges, argued the image implied the cleric had "fun" with the boy before conducting the traditional Muslim call for prayer.

A second painting shows the same cleric reclining in front of a Muslim shrine, holding a book by Brazilian novelist Paulo Coelho in one hand as he lights a cigarette for a young boy with the other. A second young boy, who is naked with his legs strategically crossed to cover his genitals, sits at the cleric's feet. The painting has caused particular uproar because verses from Islam's holy book, the Quran, appear on the shrine.

Aasim Akhtar, an Islamabad-based art critic who wrote an essay accompanying the paintings in the journal, wrote that Ali's mixing of images was "deliberately, violently profane," aimed at challenge "homophobic" beliefs that are widespread in Pakistani society.

"Ali redefines the divine through a critique of authority and the hypocrisy of the cleric," wrote Akhtar, an Islamabad-based art critic who is also listed as a potential defendant in the blasphemy complaint.

Jamaat-ud-Dawa, widely believed to be a front for the Lashkar-e-Taiba militant group, issued a statement after the paintings were published demanding the college issue a public apology and withdraw all issues of the journal.

College staff members also began receiving anonymous text messages threatening violence, said a member of the journal's editorial board. They were afraid to push back for fear of being killed, he said, speaking on condition of anonymity for fear of being targeted.

Extremists gunned down two prominent Pakistani politicians last year for speaking out against the country's harsh blasphemy laws, which can mean life in prison or even death. Human rights activists have criticized the laws, saying they are often used to persecute religious minorities or settle personal scores.

Yahya Mujahid, the spokesman for Jamaat-ud-Dawa, denied the group sent any threats but said the state should punish those responsible.

"It's part of Western and American plans to malign Islam," claimed Mujahid.

A court considering whether to press blasphemy charges held its latest session in mid-December, but it has not said when it will rule whether such charges apply in the case.

Shahram Sarwar, a lawyer representing the college's editorial board, said his clients did not intend to hurt anyone's feelings but he was prepared to apologize on their behalf if they did.

Besides shutting down the journal, the college also closed the department where its staff worked, said Sarwar.

The current head of the National Arts College, Shabnam Khan, denied the institution caved to pressure from hardliners, saying the editorial staff quit voluntarily. She said the department was closed because no one was left to run it.

A member of the editorial board disputed this version of events, saying the college administration asked him and his colleagues to resign. He spoke on condition of anonymity for fear of being targeted by extremists.

The school has long been a progressive voice. A research project at the college in 2008 focused on the idea that rising Islamic conservatism and violent religious fanaticism was a fundamental threat to peace and democracy in Pakistan. In the 1980s, when former dictator Gen. Zia ul-Haq, a notorious Islamist, ordered all female students and teachers to cover their hair, the college pushed back.

Individual graduates have pushed the envelope with their work. Amra Khan's latest work, which was exhibited at the college and a gallery in Karachi this year, included Muslim veils embroidered with a pink Playboy bunny and The Rolling Stones' big red lips logo.

Evidence of the growing influence of Islamic hardliners abounds in Pakistan. In September, clerics wielding sticks forced their way into a wedding reception in the southern city of Ghotki to stop the guests from singing and dancing. A different set of clerics forced a five-star hotel to cancel a planned concert in August in the northwest town of Bhurban because they argued the music was counter to Islam.

Hardliners have had success influencing Pakistani institutions as well. The Supreme Court ordered the country's media regulatory body in August to look into blocking "vulgar" and "obscene" content on TV in response to a petition filed by conservative Islamists.

In November, the government's telecommunications arm banned late-night cell phone call packages, saying they encouraged immoral behavior by young people. The government banned YouTube earlier this year because of an anti-Islam video posted on the site, and one of the country's highest courts has blocked access to Facebook twice because of material considered anathema to Islam.

Khan, the head of the college, refused to discuss the case in more detail because of the court proceedings, but said that people across the political spectrum were becoming more alarmed by the use of violence to enforce views.

"I have heard recently even from conservative people that enough is enough," said Khan. "It is wrong that people interfere in others' lives, that people interfere in others' beliefs."

What we?re looking at isn?t the finished hardware. While the developer kits have the same basic specs as the units that will ship to customers in April (including an NVIDIA Tegra 3 quad-core processor, 1GB of RAM, and 8GB of storage), these special edition models have clear plastic cases.

That means you can see the guts of the Ouya game console without even opening it up ? and the same goes for the 2 wireless controllers that come with the kits.

Unfortunately the game controllers are still works in progress, and the team is still working out some of the kinks.

The developer kits also include microUSB ports that let you connect the system to a computer for Android programming and debugging. It?s not clear if the final product will have that port ? but one of the key goals of the Ouya project is to create an open platform, so I can?t see why the consumer device would ship without a microUSB port.

Meanwhile, folks interested in developing games for the Ouya who haven?t been able to snag one of the limited edition developer kits can check out the Developer Portal for details on coding for the Ouya using off-the-shelf hardware to test their games.

The Ouya is available for pre-order for $99 plus shipping, and it?s expected to ship in April, 2013.

Yet, despite a culture of failure that has settled on Washington like an ice storm, there are 11th hour pressures that could drive Congress to avert at least some elements of the ?fiscal cliff? set to begin Jan. 1, including a week-long sell-off on Wall Street and a rare pledge that the GOP-controlled House will allow a vote on whatever the Democrat-controlled Senate produces.

?We just can?t afford a politically self-inflicted wound to our economy,? said President Obama in his weekly radio address on Saturday. ?The economy is growing, but keeping it that way means that the folks you sent to Washington have to do their jobs.?

Ever since the 2011 debt-ceiling crisis, the focus of efforts to come up with a deficit-reduction plan has been private talks between President Obama and House Speaker John Boehner (R) of Ohio. Those efforts collapsed last week after a critical mass of GOP conservatives rejected Mr. Boehner?s ?Plan B? to exclude incomes over $1 million from an extension of the Bush-era tax cuts.

Now, it?s up to Senate majority leader Harry Reid (D) of Nevada and minority leader Mitch McConnell (R) of Kentucky, seasoned veterans at partisan floor maneuvers to thwart the other side, to switch gears and rally support for a bipartisan deal, especially finding an acceptable cut-off point for extending the Bush tax cuts.

There are other elements of what has come to be known as the fiscal cliff ? a $600 billion mix of tax hikes and spending cuts set to take hold on Jan. 1 ? that may be postponed in the rush to an 11th hour agreement.

These include $110 billion in mandated spending cuts, known as the "sequester," unemployment benefits set to drop back to 26 weeks from a current 99 weeks, the end to a $5 million exemption for the estate tax, and a "patch" to the alternative minimum tax, set to hit some 40 million families, if Congress not act. Also on the table: a hike to the debt ceiling, now set to be breached early on Dec. 31, which the Treasury says can be delayed for weeks by?emergency measures.

In a White House meeting with congressional leaders on Friday, President Obama restated his goal of extending tax breaks only for family incomes below $250,000. But in negotiations with Boehner, the president had proposed raising that threshold to $400,000 ? a level endorsed by many Senate Republicans and likely to win the support even of some Tea Party conservatives.

Woman charged in New York firefighter slayings

(AP) ? William Spengler raised no alarms in prison for 17 years and for more than a decade afterward. Well-spoken, well-behaved and intelligent, his demeanor was praised by four straight parole boards that nevertheless denied him parole, worried that bludgeoning his 92-year-old grandmother with a hammer showed a violent streak that could explode again.

After his sentence was up in 1996, he stayed out of trouble until 2010, police said Friday. That's when Spengler went to a sporting goods store with a neighbor's daughter, picked out a Bushmaster semiautomatic rifle and a shotgun and had her buy the guns that the convicted felon couldn't legally possess. On Monday, he used the weapons to ambush firefighters lured to a blaze he set at his house in upstate Webster, killing two people and wounding three others before killing himself.

On Friday, state and federal authorities charged the woman who bought the guns, 24-year-old Dawn Nguyen, with lying on a form that said she would be the owner of the guns she bought for Spengler.

The charges involve the semiautomatic rifle and the 12-gauge shotgun that Spengler had with him Monday when volunteer firefighters Michael Chiapperini and Tomasz Kaczowka were gunned down. Three other people, including two other firefighters, were wounded before the 62-year-old Spengler killed himself. He also had a .38-caliber revolver, but Nguyen is not connected to that gun, police said.

Investigators were still working Friday to confirm their belief that a body found in Spengler's burned home was that of the sister he lived with, Cheryl Spengler, 67.

U.S. Attorney William Hochul said Nguyen bought the two guns on June 6, 2010, on behalf of Spengler. Police used the serial numbers on the guns to trace them to Nguyen.

"She told the seller of these guns, Gander Mountain in Henrietta, N.Y., that she was to be the true owner and buyer of the guns instead of William Spengler," Hochul said. "It is absolutely against federal law to provide any materially false information related to the acquisition of firearms."

During an interview late on Christmas Eve, she told police she had bought the guns for personal protection and that they were stolen from her vehicle, though she never reported the guns stolen. The day after the shootings, Nguyen texted an off-duty Monroe County Sheriff's deputy with references to the killings. She later called the deputy and admitted she bought the guns for Spengler, police said Friday.

That information was consistent with a suicide note found near Spengler's body after he killed himself. The rambling, typed letter spelled out Spengler's intention to destroy his neighborhood and "do what I like doing best, killing people."

Nguyen is scheduled to return to court on Jan. 8. She declined comment Friday, and a working phone number for her lawyer could not be found.

The .223-caliber Bushmaster rifle, which had a combat-style flash suppressor, is similar to the one used by the gunman who massacred 20 children and six women in a Newtown, Conn., elementary school earlier this month.

As police announced the charges against Nguyen, a clearer portrait of Spengler began to emerge, in the words of wary parole commissioners who kept him locked up until the law said they had to let him go.

At his final parole hearing in 1995, the then-45-year-old Spengler repeated his desire to get out of prison while he still had time to rebuild his life. He also took issue with a previous decision not to release him because the board believed he remained a danger to society.

"You know, the only area of confusion, the last Board, they said that I might be a danger to the community at that time," he said. "I can't figure out where in my record it shows that."

"Well, 13 shots to the head. The grandmother. You killed a 92-year-old woman. We are worried about that," a board member replied. "There might be another occasion where you lose your temper and you might repeat that behavior. That is what frightens us. That frightens us."

During four hearings between 1989 and 1995, Spengler quarreled with parole board members over details of his grandmother's killing, insisting each time he'd only hit her three times on the head with a hammer while evidence pointed to 13 blows, and initially saying he couldn't explain why the attack happened.

He told the commissioners he took care of his father's mother in her home next to his because others in the family had difficulty dealing with her, in part because she could be violent. He denied insinuations he was taking financial advantage of Rose Spengler.

The transcripts reveal a well-spoken man, proud to be staying out of trouble in prison and earning positions of trust and responsibility, even time out of prison with a work crew that did renovation work in places including a century-old chapel. The board members mention Spengler testing high for intelligence and noted he came to prison with no other crimes on his record, had only dabbled in drug use and had a spotty work history, mostly as a house painter.

On the day of the killing, he said, he planned to nail shut a basement door to prevent his grandmother from going down and endangering herself. But he said she attacked him, inadvertently kneed him in the groin, and he hit her with the hammer.

"So why do you think you killed her?" Spengler was asked in 1989.

"I still haven't figured that out. It was matter of just wanting to get out. She was between me and the door," he replied.

"She was just a little, bitty old lady," a board member commented.

"I realize that. That's why I still can't explain it," Spengler said.

Help Save a Life on Human Rights Day: Sign a Petition to Stop Organ Harvesting Abuses in China

NEW YORK -- Looking for a meaningful gesture to mark International Human Rights Day today? The Falun Dafa Information Center encourages Americans to sign a petition to President Obama urging him to investigate and condemn organ harvesting abuses in China. Just go to?www.organpetition.org.

A trio of medical doctors initiated the petition on December 2 calling upon the Obama administration to investigate and help stop forced organ harvesting from innocent Falun Gong believers illegally imprisoned in China. The petition is posted within the ?We the People? section of the White House website, whose regulations state that the White House guarantees a response to any petition that secures 25,000 signatures within 30 days.

The petition collected over 5,000 signatures during its first week, but more are needed to ensure the required 25,000 goal is reached in time and action is taken immediately to save the lives of people in China.

?We are very concerned about one of the most horrifying crimes against humanity of our time: Forced organ harvesting from living ?prisoners? in China. Killing for parts is a gross violation of medical ethics,? wrote Drs. Arhur Caplan, Alejandro Centurion and Jianchao Xu in an open letter they released upon initiating the petition. ?

Arthur Caplan, Ph.D, is director of medical ethics with New York University's Langone Medical Center. Dr. Centurion is a practicing physician in California, while Dr. Jianchao Xu is a kidney specialist with Mount Sinai Hospital in New York City. Amidst efforts to end unethical medical practices around the world, all three doctors have been working over the past six years to investigate, expose, and put an end to organ transplant abuses in China.?

As the Falun Dafa Information Center has reported previously, since 2006, evidence has emerged of organ harvesting from illegally imprisoned Falun Gong practitioners (fact sheet). Unlike other countries, China has no large-scale voluntary organ donation system, so instead, military hospitals use prisoners. Experts now estimate that tens of thousands of jailed Falun Gong believers and other prisoners have been systematically examined, and then used as a living organ donor bank, killed on demand to fuel China's lucrative transplant industry.

The U.S. State Department?s 2011 Human Rights Report cited allegations of organ harvesting from Falun Gong believers and other prisoners of conscience. In October, 106 members of Congress wrote to Secretary Clinton requesting the release of information the State Department is believed to have about the gruesome practice. Two Congressional hearings have covered the topic, while leading transplantation doctors and medical organizations from around the world have condemned this crime against humanity.

In July of 1999, China's autocratic Communist Party launched an unlawful campaign of arrests, violence, and propaganda against Chinese citizens practicing Falun Gong (or "Falun Dafa") with the intent of "eradicating" the apolitical practice. Former Communist Party leader Jiang Zemin launched the persecution fearing the practice's growing popularity among the Chinese people (70 to 100 million) was overshadowing his own legacy (article). Since then, the Falun Dafa Information Center, based in New York, has reported over 3,500 deaths from abuse and over 80,000 cases of torture. The United Nations, Amnesty International, Chinese human rights lawyers, and foreign media have also documented Falun Gong torture and deaths at the hands of Chinese officials (samples). Hundreds of thousands of Chinese who practice Falun Gong remain in captivity, rendering them the single largest group of prisoners of conscience in China (article). Falun Gong is a traditional Chinese spiritual discipline that is Buddhist in nature, but not part of the religion of Buddhism. It consists of slow-moving "qigong" exercises, meditation, and teachings for daily life centered on the tenets of truthfulness, compassion, and tolerance (about Falun Gong).

WARSAW, Poland (AP) ? A statue of Adolf Hitler praying on his knees is on display in the former Warsaw Ghetto, the place where so many Jews were killed or sent to their deaths by Hitler's regime, and it is provoking mixed reactions.

The work, "HIM" by Italian artist Maurizio Cattelan, has drawn many visitors since it was installed last month. It is visible only from a distance, and the artist doesn't make explicit what Hitler is praying for, but the broader point, organizers say, is to make people reflect on the nature of evil.

In any case, some are angered by the statue's presence in such a sensitive site.

One Jewish advocacy group, the Simon Wiesenthal Center, this week called the statue's placement "a senseless provocation which insults the memory of the Nazis' Jewish victims."

"As far as the Jews were concerned, Hitler's only 'prayer' was that they be wiped off the face of the earth," the group's Israel director, Efraim Zuroff, said in a statement.

However, many others are praising the artwork, saying it has a strong emotional impact. And organizers defend putting it on display in the former ghetto.

Fabio Cavallucci, director of the Center for Contemporary Art, which oversaw the installation, said, "There is no intention from the side of the artist or the center to insult Jewish memory."

"It's an artwork that tries to speak about the situation of hidden evil everywhere," he said.

The Warsaw ghetto was an area of the city which the Nazis sealed off after they invaded Poland. They forced Jews to live in cramped, inhuman conditions there as they awaited deportation to death camps. Many died from hunger or disease or were shot by the Germans before they could be transported to the camps.

The Hitler installation is just one object in a retrospective of Cattelan's work titled "Amen," a show that explores life, death, good and evil. The other works are on display at the center itself, which is housed in the Ujazdowski Castle.

The Hitler representation is visible from a hole in a wooden gate across town on Prozna Street. Viewers only see the back of the small figure praying in a courtyard. Because of its small size, it appears to be a harmless schoolboy.

"Every criminal was once a tender, innocent and defenseless child," the center said in a commentary on the work.

Poland's chief rabbi, Michael Schudrich, said he was consulted on the installation's placement ahead of time and did not oppose it because he saw value in the artist's attempt to try to raise moral questions by provoking viewers.

He said he was reassured by curators who told him there was no intention of rehabilitating Hitler but rather of showing that evil can present itself in the guise of a "sweet praying child."

"I felt there could be educational value to it," said Schudrich, who also wrote an introduction to the exhibition's catalogue in which he says art can "force us to face the evil of the world."

On Friday, a stream of people walked by to view the work, and many praised it.

"It had a big emotional impact on me. It's provocative, but it's not offensive," said Zofia Jablonska, a 30-year-old lawyer. "Having him pray in the place where he would kill people ? this was the best place to put it."

Cattelan caused controversy in Warsaw in 2000 when another gallery showed his work "La Nona Ora" ? or "The Ninth Hour" ? which depicts the late Pope John Paul II being crushed by a meteorite. That offended many in Poland, which is both deeply Catholic and was John Paul's homeland.

BERLIN (AP) ? The case of an 87-year-old Philadelphia man accused by Germany of serving as an SS guard at Auschwitz has largely centered on whether he was stationed at the part of the death camp used as a killing machine for Jews.

Johann "Hans" Breyer ? while admitting he was an Auschwitz guard ? insists he was never there.

World-War II-era documents obtained by The Associated Press indicate otherwise.

The files provided by the U.S. Department of Justice in response to an AP request are now in the hands of German authorities, and could provide the legal basis for charging him as an accessory to the murder of hundreds of thousands of Jews in the Nazi death camp.

The retired toolmaker told the AP in September, when German authorities confirmed he was under investigation, that he was always at Auschwitz I, a smaller camp used largely for slave labor, and never entered Auschwitz II, also known as Auschwitz-Birkenau, where about 90 percent of the 1.1 to 1.5 million Jews and others killed in the camp were murdered.

The U.S. Justice Department documents tell a different story. One SS administrative document specifically notes that Breyer was an SS guard at Auschwitz II. Another indicates he served with a unit of the SS Totenkopf, or "death's head," that was assigned to guard Birkenau.

Kurt Schrimm, the head of the special German prosecutors' office responsible for investigating Nazi-era crimes, which has recommended charges be brought against Breyer in Germany, would not comment on specific pieces of evidence. But he said his office felt there was a strong enough evidence to prove that Breyer served in Birkenau.

"American authorities have been very cooperative in this case and have turned over a lot of evidence," he said.

Breyer did not respond to requests for comment; his attorney, Dennis Boyle, said that he was aware of the documents but would not comment on their possible significance. "We are continuing our investigation and have no comment at this time," Boyle said.

The U.S. Department of Justice used the documents as part of its unsuccessful decade-long legal efforts to have Breyer stripped of his American citizenship and deported. The U.S. case centered upon issues such as whether Breyer had lied on his immigration papers and whether he had obtained U.S. citizenship through his American-born mother. That legal saga ended in 2003, with a ruling that allowed him to stay in the United States, mainly on the grounds that he had joined the SS as a minor and could therefore not be held legally responsible for participation in it.

The German investigation, by contrast, tries to prove that Breyer was a death camp guard, and the documents are now being used to support that case.

The dossier is now with prosecutors in the town of Weiden, near where Breyer last lived in Germany. The prosecutors are reviewing whether there is enough evidence to charge him with accessory to the murder of least 344,000 Jews as Schrimm's office has recommended, and have him extradited from the U.S.

For decades after the war, German prosecutors were only been able to convict former Nazi guards if they could find evidence of a specific crime. But with the case of former Ohio autoworker John Demjanjuk, the legal thinking changed: Prosecutors were able to successfully argue that evidence of service as a death camp guard alone was enough to convict a suspect of accessory to murder.

Demjanjuk always denied being a guard anywhere. He died in March while appealing his conviction on 28,060 counts of accessory to murder. Breyer, however, acknowledges that he served with SS Totenkopf guard units ? although not the one that served at Birkenau ? and was stationed both at Buchenwald, a concentration camp located in Germany, and Auschwitz.

"I didn't kill anybody, I didn't rape anybody ? and I don't even have a traffic ticket here," he told the AP in an interview at his home in northeastern Philadelphia in September. "I didn't do anything wrong."

He said he was aware of what was going on inside the death camp, but did not witness it himself. "We could only see the outside, the gates," he said. The interview was the only one Breyer has given to the media.

Breyer was born in 1925 in what was then Czechoslovakia to an ethnic German father and an American mother, Katharina, who was born in Philadelphia. Slovakia became a separate state in 1939 under the influence of Nazi Germany. In 1942, the Waffen SS embarked on a drive to recruit ethnic Germans there. Breyer joined at age 17 and was called up in 1943.

In testimony in 2002, he told the U.S. District Court in Pennsylvania that he had been sent to Auschwitz from Buchenwald in May 1944, then was given leave in August and returned home. He testified that he stayed in hiding in and around his home until the Soviet army closed in.

According to Breyer, the town's mayor provided him a letter asking for authorities to excuse his desertion because he had been needed on the family farm. Breyer testified that the letter worked with Nazi authorities, and that he was able to eventually rejoin his unit fighting outside Berlin in the final weeks of the war.

The documents, however, call his testimony into question, suggesting he was at Auschwitz through the rest of 1944 and into 1945, which would have meant he was there during the time some 426,000 Hungarian Jews were deported to Auschwitz, 320,000 of whom went directly into the gas chambers in Auschwitz-Birkenau.

A form from SS administrative authorities, filled out on Jan. 17, 1945 in Pressburg, which today is Bratislava, Slovakia, indicates that the previous day Breyer was there in person and applied for ? and was granted ? financial assistance for his parents' farm while he was away serving in the SS.

And it notes that Breyer at the time of the application was based at "Auschwitz 2."

In a 2002 case in the United States, the judge questioned the trustworthiness of the document ? noting among other things that the birthdates of both of Breyer's parents were wrong, and the size of his family farm was written down as double what it actually was. In his testimony, Breyer suggested the document was "a fraud."

But a court expert testified there was no evidence of a forgery. And U.S. federal prosecutors noted that Breyer's date of birth, date of induction into the SS, profession, parents' names and hometown are all correct. They also cited Breyer's first interrogation in 1991, when he told investigators he had gone home after "they granted me vacation end January '45" ? which fits with the timeline of the document.

In the current German case, Thomas Walther, a former prosecutor in Schrimm's office, said it was also plausible to think that Breyer would have made his parents seem older, and his farm larger, in order to bolster the case for receiving assistance.

If nothing else, he said, the document and other evidence raise enough suspicion for prosecutors to file charges.

"Where this evidence fits has to be decided at trial, regardless of what the U.S. judge said the German court needs to decide," said Walther, who is now in private practice and represents several family members of Jewish victims at Auschwitz who have joined the investigation as co-plaintiffs as allowed under German law.

Weiden prosecutor Gerhard Heindl, who is heading the current investigation, said he could not comment on any evidence.

Another document, an April 26, 1944 letter to the SS administration in Pressburg from the leader of the pro-Nazi Slovakian "Deutsche Partei," makes a case to have Breyer excused from his duties to help on his family's farm, noting that he was assigned at the time to the 8th Company of the SS Totenkopf in Auschwitz.

The 8th Company was stationed at Auschwitz II during the time Breyer is alleged to have been there, according to camp orders cited by Raul Hilberg in his book "The Destruction of the European Jews."

A U.S. Army intelligence file on Breyer, obtained by the AP, from a 1951 immigration background check also lists him as being with the SS Totenkopf in Auschwitz as late as Dec. 29, 1944 ? four months after he said he deserted. The Army Investigative Records Repository file was obtained by the AP from the National Archives through a Freedom of Information Act request.

"Clearly we can't say what the result will be at the end of a long presentation of evidence to a court ? that's not our job," Walther said. "But our contention is with this evidence the state prosecutors must file charges."
