Court wins drew big crowds to gay pride parades

SAN FRANCISCO (AP) ? Gay rights supporters crowded parade routes in San Francisco, New York and other major U.S. cities on Sunday ? but this year's pride celebrations were especially lively after a week that saw the Supreme Court issue two major decisions on gay marriage.

Among the thousands at San Francisco's event, now in its 43rd year, were scores of teenage girls, opposite-sex couples and families with children.

"You can feel the smiles," Graham Linn, 42, of Oakland said as he stood on a three-foot-tall building ledge surveying the crowds standing 10-deep on the sidewalks. "All around you there is a release. There is a vindication, and you can feel it."

The biggest applause went up for the two newlywed couples whose legal challenge of Proposition 8 made it possible for Californians to wed.

The couples ? Kris Perry and Sandy Stier of Berkeley, and Paul Katami and Jeff Zarrillo of Burbank ? waved from convertibles as a group of people carrying cartoon-style signs that read, "Prop. 8-Kapow!"

Human Rights Campaign President Chad Griffin, who orchestrated the lawsuit, and screenwriter Dustin Lance Black, who won an Academy Award for the movie about the slain gay rights leader Harvey Milk, marched with them.

"It's so historic," Jeff Margolis, 58, said. "So many of us could never imagine this would happen, that people would be able to do what they want for the rest of their lives."

Loud cheers went to House Democratic Leader Nancy Pelosi, Lt. Gov. Gavin Newsom and state Attorney General Kalama Harris ? straight politicians who have been vocal advocates of same-sex marriage.

San Francisco's parade lineup illustrated how mainstream support for same-sex marriage has become. Companies such as Facebook and supermarket chain Safeway were represented. Police officers and sheriff's deputies marched while holding hands.

There was also a group that called itself "Mormons for Marriage" that drew enthusiastic applause. The Mormon Church was one of the main sponsors of Proposition 8, the 2008 voter initiative that outlawed same-sex marriage in California.

The Supreme Court on Wednesday struck down Proposition 8 and also invalidated part of a 1996 federal law that denied spousal benefits to gay couples. On Sunday morning, Justice Anthony Kennedy denied a last-ditch request from the sponsors of Proposition 8 to halt the issuance of same-sex marriage licenses in the nation's most populous state.

San Francisco City Hall remained open on Sunday so couples who wanted to marry could obtain their licenses. Every other clerk in California's 58 counties will be required to issue same-sex marriage licenses starting Monday.

Parade organizers planned to hold a VIP reception for the newlyweds following the parade.

The parade in New York City, where the first pride march was held 44 years ago to mark the one-year anniversary of the Stonewall Inn riots that kicked off the modern gay rights movement, also was a sort of victory lap for Edith Windsor, the 84-year-old widow who challenged the federal Defense of Marriage Act after she was forced to pay $363,053 on the estate of her late wife.

Windsor, who was picked as a grand marshal of New York's parade months before she won her case before the Supreme Court last week, walked up Fifth Avenue during the event and recalled watching it on television in past years with her wife, Thea Spyer, before Spyer died in 2009.

"I love it obviously," she said. "If someone had told me 50 years ago that I would be the marshal of New York City gay pride parade in 2013 at the age of 84, I never would have believed it."

In Seattle, the two women who were the first same-sex couple to be granted a marriage license in Washington state after same-sex marriage became legal there last year, Jane Abbot Lighty and Pete-e Petersen, helped raise a giant marriage equality sign featuring a red equal sign on top of the city's iconic Space Needle for the first time.

In another first, the Seattle Mariners flew a rainbow flag ? the symbol of gay pride first unfurled during San Francisco's parade in 1978 ? during their game Sunday against the Chicago Cubs.

The Supreme Court wins motivated many first-time pride parade spectators, including Michael Pence, 53, and John Moehnke, 46, a North Carolina couple who are engaged, attended Chicago's annual Pride Parade for the first time, saying they were thrilled about the Supreme Court's decisions.

The couple from North Carolina planned to marry in New York in the fall, but want to see gay marriage extended to other states including Illinois, where they attended the parade with a church group.

"We have such a long way to go but we're ready for the fight," Moehnke said.

Efforts to legalize gay marriage in Illinois have stalled. Advocates started the year with intense momentum and received backing from President Barack Obama and Illinois' top political leaders. The measure cleared the Illinois Senate on Valentine's Day, state Rep. Greg Harris, the bill's sponsor, decided not to call a vote in the House because he didn't have the needed support.

Harris was one of several politicians at the parade Sunday. He said he would bring back the issue in the fall, adding that the Supreme Court's rulings have resonated with his colleagues in the Illinois House.

"Illinois is in a truly second-class status until we pass marriage equality," Harris said.

Egypt braces for a decisive showdown in the streets

Both supporters and opponents of President Mohamed Morsi agree that he faces a defining moment as streets fill with protesters calling for his resignation.?

Hundreds of thousands of Egyptians poured into the streets in the capital and around the country to call on their first freely elected president to resign, in a move that many on both sides of the stark political divide feel could be decisive for Egypt's future.

Protesters at the presidential palace in the capital chanted "Leave! Leave!" and carried signs against the Muslim Brotherhood, the Islamist organization of which President Mohamed Morsi is a former leader.?They hoped to force Mr. Morsi to leave power just as they toppled former President Hosni Mubarak in 2011.?

They say Morsi, who took office one year ago after winning an election by a razor-thin margin, has acted undemocratically and sought to increase his power while failing to solve the mounting crises in Egypt. Many have been pushed to the street by growing anger over electricity cuts, fuel shortages, food price increases, and a lack of security.

Yet the president's supporters ? and thousands of them have gathered at a mosque in Cairo since?Friday?to counter-protest ? say the demonstrations against the president are supported by members of the former regime, who are attempting to oust a democratically elected president against the will of the people. They accuse the opposition of encouraging violence and hoping for a coup.?

One side sees the protests as Egypt's last chance to save a transition that had gone badly awry, while the other side sees them as a threat to Egypt's young democracy.?

"This is our last chance to rescue Egypt," says Mohamed Fouad, a protester at the presidential palace who holds a sign that says "get out!"

Some fear the protests may cause the bitter rift between the president's supporters and opponents to erupt into wider violence. That divide has been growing since the president granted himself immunity from the judiciary in November and used the power to push to a vote a new constitution written by a committee whose majority were Islamists.?

A sheikh at Al Azhar, the seat of Sunni Muslim learning, last week warned about a slide into civil war. And the military, which stepped in to take control when former President Hosni Mubarak was ousted in 2011, warned that it will not stand by if chaos engulfs the nation.

The?Sunday?headline in opposition daily Shorouq captured the tension hanging over Cairo: ?Egypt awaits her fate,? it read.

The violence has already begun in the Nile Delta region, where several people have died in recent days in clashes between pro-and anti-Morsi protesters. One of them was 21-year-old American Andrew Pochter, who was working as an intern at an American development organization, teaching English to students. He was stabbed to death, apparently while observing a protest in Alexandria?Friday. Several local offices of the Muslim Brotherhood have been torched in the Delta. Videos of protests there appear to show some Morsi opponents carrying guns and knives.

At the demonstration in support of Morsi in Cairo, men wore helmets and carried sticks and shields, which they say they would use to defend themselves if attacked.?

"We cannot allow thugs and corrupt members of the former regime to oust Egypt's democratically elected leader," says Said Ahmed, one of the helmet-clad defense crew. "The ballot box has spoken. Will they do this to every president if they are not happy with everything he does? This is not democracy."

Looking for a new leader

But at the presidential palace, protesters say Morsi has betrayed those who voted for him. Samia Awad, a mother who came to the protest with her children, says she voted for Morsi last year but now is deeply disappointed. "He hasn't done anything for Egypt. Everything is worse," she says. "We want a leader who will offer us a life, who will move the country forward. This doesn't mean we will oust a new president every year. If anyone comes and does something for the country, we will support him. We want security, we don't want this chaos we are living in."

Many protesters say they feel Morsi is working for the benefit of the Muslim Brotherhood, and not in the interests of the people. Mostafa el Ghobashy says he wants Morsi to step down, and a presidential council to take his place. He also wants a new constitution to be written. Concessions by Morsi won't make him happy, he says. "The time for that had passed. We asked for that many times, and he didn't answer. He didn't listen to the people."

Some palace protesters brought up the violence in December, when the Brotherhood sent its members to disperse opposition protests at the presidential palace and eleven people were killed in the ensuing clashes.?

Cairo braces for clashes

In the days leading up to?Sunday, apprehension gripped the Egyptian capital as residents worried about what the protests would bring. Some Cairo residents stocked up on food, bottled water, and cash. Some stores ran out of supplies, and banks lowered daily ATM withdrawal limits. Away from the protests?Sunday, Cairo's streets, normally full of traffic, noise, and pedestrians, were almost deserted, and eerily quiet. The American embassy issued a travel warning for Egypt and announced it would be closed?Sunday?and?Monday.

Leaders of the petition drive that called for today's anti-Morsi protests, called Tamarod, or ?Rebel,? say they gathered 22 million signatures asking the president to resign. That number cannot be verified.?

What is clear is in the year since he was elected, Morsi has alienated many who voted for him. Some are angry at what they call autocratic moves and attempts to consolidate power while refusing to give concessions to the opposition. And Egypt's economic woes have mounted, putting financial pressure on citizens, as his government has failed to conclude a crucial loan deal with the IMF.

The president's supporters note that he has faced many hurdles ? he has struggled to control the security forces, and they say he faces a judiciary and media determined to thwart his moves, while the political opposition refuses dialogue.

But Morsi is not the only one facing opposition. Anti-American sentiment has also grown in Egypt as many of Morsi's opponents view the US as unquestioningly supporting Morsi or engaging in a conspiracy to bring him to power. At the palace, protesters carried signs demanding the expulsion of the American ambassador, Anne Patterson.?

(AP) ? Hundreds of relatives, friends and teammates wept together and hugged Saturday at the funeral of a semi-pro football player whose killing led to murder and weapons charges against former New England Patriots player Aaron Hernandez.

The body of Odin Lloyd was found June 17 near Hernandez's home. Police arrested Hernandez on Wednesday and charged him with orchestrating the execution-style shooting.

Lloyd played for the Boston Bandits and was dating the sister of Hernandez's fiancee. Members of Lloyd's team showed up for the funeral in their uniforms and chanted his name as pallbearers placed his casket in a hearse outside Church of the Holy Spirit in Boston's Mattapan neighborhood. The crowd of mourners was so large that some could not find room inside the church for the two-hour service.

Hernandez has pleaded not guilty and is being held without bail. Two other men are also in custody. Prosecutors say the three were in a car with Lloyd shortly before his death.

Authorities have said trouble that led to Lloyd's killing happened June 14, when Lloyd went with Hernandez to a Boston nightclub. Hernandez became upset when Lloyd began talking with people Hernandez apparently didn't like, prosecutors said.

On June 16, the night before the slaying, a prosecutor said, Hernandez texted two unidentified friends and asked them to hurry to Massachusetts from Connecticut.

A few minutes later, he texted Lloyd to tell him he wanted to get together, prosecutors said. Authorities say Hernandez, Carlos Ortiz and Ernest Wallace picked up Lloyd at around 2:30 a.m. June 17, drove him to an industrial park near Hernandez's home and shot him five times. They have not said who fired the shots.

Prosecutors said an ammunition clip found in Hernandez's Hummer matched the caliber of casings found at the scene of Lloyd's killing.

Hernandez's lawyer argued in court that the case is circumstantial. He said Hernandez, who was cut by the Patriots the day he was arrested, wanted to clear his name.

Ortiz's attorney, John Connors, said he will seek bail for his client at the July 9 hearing. He described Ortiz as a "gentle person" and said he will advise Ortiz to plead not guilty to the gun charge he is facing.

Wallace surrendered in Miramar, Fla., on Friday, police said. Authorities had been seeking Wallace on a charge of acting as an accessory after Lloyd's murder. Details of that allegation weren't released.

Hernandez was drafted by the Patriots in 2010 and signed a five-year contract worth $40 million last summer. He could face life in prison if convicted.

Mandela family feud over where he should be buried

JOHANNESBURG (AP) ? As Nelson Mandela remained in critical condition in hospital Friday, a family feud over where the 94-year-old former president should be buried went to the courts, according to South Africa's national broadcaster.

Mandela's oldest daughter, Makaziwe, and 15 other family members have pressed a court application to get Mandela's grandson to return the bodies of three of Mandela's children to their original graves in the eastern rural village of Qunu, according to the SABC.

The grandson, Mandla Mandela, acknowledges having reburied the three bodies 20 kilometers (13 miles) away in the Mvezo village, where he plans to create a Mandela shrine, hotel and soccer stadium, according to the South African Press Association.

Grandson Mandla Mandela has until Saturday to respond to the court filing, reports said.

The anti-apartheid leader built his retirement home in Qunu and was living there until his repeated hospitalizations which started at the end of last year. Nelson Mandela attended the burial of his son at the family plot in Qunu in 2005, and it was widely expected that the leader himself will be buried there.

But his grandson exhumed the bodies of Mandela's three children and moved them to nearby Mvezo, which is the former president's birthplace and where the grandson holds authority as chief.

Eldest daughter Makaziwe and other Mandela family members want the family bodies returned to their original graves in Qunu, according to the reports.

The family court struggle came as Mandela's ex-wife said that he had improved in recent days, but remained critical.

Winnie Madikizela-Mandela gave the update Friday while speaking to journalists outside Mandela's former home in Soweto.

"I'm not a doctor but I can say that from what he was a few days ago there is great improvement," said Madikizela-Mandela, who is a member of South Africa's Parliament.

Madikizela-Mandela pleaded with the media to "understand the sensitivities and the feeling of the family."

His daughter Makaziwe Mandela was among the family members who arrived at the Pretoria hospital on Friday. The ministers of health and defense also visited, the South African Press Association reported.

Outside the Pretoria hospital on Friday, a man flying a drone-like object with a camera attached was led away by several policemen, adding to an already heightened atmosphere where well-wishers continue to gather to pray for Mandela.

Mandela was taken to the hospital on June 8 to be treated for what the government said was a recurring lung infection. South Africans have held prayers nationwide, and many have left flowers and messages of support outside the hospital as well as his home in Johannesburg.

On Thursday, the office of South African President Jacob Zuma said Mandela's health had improved overnight, and that his condition was critical but stable.

Firefox gets a new logo, rolls out Beta update that gives devs access to its Social API

Firefox is an ever evolving beast, and that includes both its friendly orange fox logo, and its Beta channel browser. Today Mozilla unveiled the fourth Firefox logo, a (slightly) less textured and glossy icon for its favored web browser -- and if you're . Meanwhile, the latest update for for Firefox Beta brings access to the company's Social API and, consequently, Share buttons to the platform -- so Facebook fanatics can have one-click sharing of images, articles, videos and links from the Firefox toolbar. The new Beta is also getting a Mixed Content Blocker that prevents HTTP (read: nonsecure) content from loading on HTTPS websites. Plus, there's a new Network Monitor feature to let devs see how quickly individual page components load and optimizations for OS X 10.7 that enable its scrollbar style and and the scroll bounce behavior Apple fans love.

Oh, and for you mobile fans, the Android Beta was updated today, too. Now, it's got an auto-hide Awesome Bar, a URL autocomplete function and an updated RSS feed reader that allows you to add feeds to with a long press on the aforementioned Awesome Bar. Pretty awesome, gents, now let's get these Beta features into a full release, and it'll be really awesome.

ITC judge rules against InterDigital in first round of 3G patent case (update)

After two long years, the International Trade Commission has finally come to a decision in favor of Huawei, Nokia and ZTE in a 3G patent case brought by InterDigital in 2011. According to an ITC judge, the three phone manufacturers did not violate the seven InterDigital-owned patents that covers various WCDMA and CDMA2000 technologies used to make their devices. InterDigital even went so far as to request the ban of US sales of these devices pending a decision. The Pennsylvania-based company filed a similar complaint against LG, which chose a settlement instead of going through the courts but it argued it had a right to arbitration based on a previous licensing agreement and was taken out of the case (see update below). Still, this is just a preliminary ruling; the final decision of the case is expected in October.

Update: The story initially said LG chose a settlement instead of going through the courts, which is incorrect. We learned from InterDigital that while LG was in the original case, the ITC took the Korean company out once LG said it had a right to arbitration. However, the Court of Appeals of the Federal Circuit ruled earlier in June that the ITC has made a mistake in excluding LG. So, LG could still face the initial charges brought to it by InterDigital.

The Tatum Family: Baby Shower

This past weekend, Jack had his first baby shower hosted by mommy's best friends Amee and Madeline. Emilee (Ashlee's soon to be daughter)was the fellow guest of honor. Amee and Madeline threw the most beautiful shower. It was us four girls and our four moms which was so fun as we have been best friends for 15 years and I truly feel all their families are my family. I honestly don't know many people who can say they have had their best friends for as long as we have. What is as equally amazing is that Hannah has had three built in best friends practically from birth and now Jack is due just two weeks before Emiliee so they can be best friends too. We love to joke that two of them are sure to date at some point, the kids will always have back up prom dates, and at some point Hannah will no longer be the tallest and instead be surrounded by big teenage boys with facial hair and deep voices. Crazy. Anyway back to the shower. I felt so blessed and loved and it was fun sharing the memory with Ashlee. Madeline and Amee made the house look beautiful with white flowers, china and the cutest 'shower theme' decor. They did a brunch which was absolutely delicious. Both mommies had seconds. The babies got spoiled with tons of gifts and I had so much fun showing Hannah when I got home and putting everything away.

Sony SmartWatch 2 unveiled: a water-resistant 'second screen' for Android devices

Sony's taking a second stab at the fledgling wearable category it helped pioneer with today's announcement of the SmartWatch 2. The Android-powered wristwatch retains the familiar remote functionality of its predecessor (i.e., allowing users to answer calls, read email and texts, snap photos, etc.), albeit now from a larger, 1.6-inch (220 x 176) touch display. Sony's packed all of this "second screen" functionality into a handsome, aluminum body design that's crafted to be dust- and water-resistant (IP57), much like the Xperia Z line before it. And for users that want a little variety, the company's also offering a pack-in stainless steel wristband that can be swapped out for any other 24mm strap (Sony plans to offer alternative straps sometime soon).

The SmartWatch 2 also features support for NFC and Bluetooth 3.0, so you can easily pair it with compatible devices running Android 4.0 or higher -- something like the Xperia Z Ultra, perhaps. As for battery life, Sony claims the SmartWatch 2's rated for a maximum of four days with moderate use. But those with a lighter touch, or a penchant for digital wristwatches, may be able to eke out a full week's worth of juice. There's no pricing information to share at the moment, only a semi-concrete global release date for this September. Which is just about enough time for you (or, more likely, your Dad) to dust off that Dick Tracy impersonation.

Idolian Mini Studio


Like most Apple copycats, the Idolian Mini Studio ($178 direct) looks the part, but is a far cry from the iPad mini?it shamelessly apes. It's more of a scaled down Studio 10, with essentially the same internal components and software, but a smaller and lower-resolution display. If you're on a strict budget, the Mini Studio will net you basic tablet functions on the cheap, but spending just a bit more can get you a vastly superior Google Nexus 7?or Amazon Kindle Fire HD. And if you want to go even lower, the Coby MID8065?offers similar performance and features for less.

Design and Features
The Mini Studio is a tweener, with its 8-inch screen and 4:3 aspect ratio?clearly aimed to mimic the iPad mini. At 8.2 by 6.4 by 0.39 inches (HWD) and 14.8 ounces, it's relatively thin and light, but still doesn't come close to matching the fit or finish of the iPad. It feels more solidly built than the MID8065?and is a bit lighter to boot.?The aluminum back is sturdy, but the edges can feel sharp and dig into your palms over time.

A plastic panel along the left edge houses a microSD card slot, a 3.5mm headphone jack, micro USB and mini HDMI ports, and a DC power input. Like the Studio 10, the Mini Studio syncs via micro USB, but requires the included power brick to charge. The micro USB port also supports USB OTG, and Idolian includes an adapter for plugging in peripherals like USB mice and keyboards?both of which worked fine in my tests. It's a generous selection of ports compared with the Nexus 7 or the Kindle Fire HD.?

The 8-inch, 1,024-by-768 IPS display is sharp, but it's a bit too dim and colors appear too cool. Whites have a distinct blue hue to them and outdoor visibility is pretty bad. The Nexus 7 and Kindle Fire HD have sharper and brighter displays, while the iPad mini easily trounces the Mini Studio. It's about on par with the display on the MID8065.

This is a Wi-Fi-only tablet that connects to 802.11b/g/n networks on the 2.4GHz frequency. During testing, the Mini Studio had some trouble reconnecting to Wi-Fi networks when woken from sleep?there were noticeable delays even though saved networks were within range. The tablet also supports Bluetooth 2.1 and connected easily with a pair of wireless headphones.

Performance and Android
The Mini Studio is packing pretty much identical specs to its larger sibling?a dual-core 1.6GHz Cortex-A9 processor with 1GB RAM. Performance is generally swift, and the Studio 10 did well on most of our benchmarks?besting the MID8065 in many categories. Gaming performance is decent, with games like Temple Run 2 running without a hitch, but don't expect high framerates on more graphically intensive games like Real Racing 3.

The software loaded onto the Mini Studio is a mixed bag. It's running Android 4.1.1 "Jelly Bean," which is a step up from the MID8065's 4.0 "Ice Cream Sandwich," but buggy Google apps hold this tablet back. Google apps like the Play Store, Gmail, and Chrome are disabled by default?you have to dig into the settings, find Developer options, then uncheck "Hide Google Application." Idolian says it is still working out the kinks with its Google certification, but promised future firmware updates to resolve any bugs. As it stands, the Mini Studio can access the Play Store and its hundreds of thousands of apps, but I found frustrating deficiencies, like the fact that Chrome did not work during testing.

For media support, the Studio 10 handles Xvid, DivX, MPEG4, H.264, and AVI videos at up to 1080p resolution. For audio, you get MP3, AAC, FLAC, OGG, WAV, and WMA support. Screen mirroring worked fine using a mini HDMI cable, and the tablet was able to output video at 720p or 1080p resolution. If you absolutely need a camera on your tablet, there are front- and rear-facing 2-megapixel cameras, but they are not worth using?details are smudged, image noise is overwhelming, and dynamic range is non-existent.

In our battery rundown test, which loops a video with screen brightness set to max and Wi-Fi on, the Mini Studio lasted 4 hours, 55 minutes. Compare that with the MID8065's 3 hours, 11 minutes and the Nexus 7's 10 hours, 30 minutes in the same test?it's decent, but not great.

Conclusions
When it comes to small-screen tablets, you have a lot of great options, even in the budget-conscious realm. While the Idolian Mini Studio looks and feels like a premium tablet, it's lacking the software refinement that makes tablets like the Nexus 7 or Amazon Kindle Fire HD stand out. On top of that, there are a few clear compromises in terms of display quality and software polish. If you simply want the least expensive and functional tablet, the Amazon Kindle Fire (2012)?is still a good choice too. I'd recommend any of these tablets over the Mini Studio, and if you really need the microSD card slot and HDMI out, the MID8065 is a better value.?

It?s impossible to write about the case of Baby Veronica, the subject of a ruling by the Supreme Court on Tuesday, without calling it heartbreaking. This is a child who was adopted at birth by a South Carolina couple, then turned over, at the age of 2, to her Cherokee birth father. He won custody based on the Indian Child Welfare Act, which Congress passed in 1978 for the entirely worthy purpose of preventing the removal of Indian children from their tribes and families. Now Veronica is 3?, and her life is up in the air again. The Supreme Court says the South Carolina courts made a mistake in taking her from her adoptive parents.

Now what? More fighting in court. More uncertainty for a little girl who can?t possibly understand all of what?s happening but can only be deeply affected by this long battle over who her family is and who will raise her. No child should go through this. And preventing that should matter more than anything else.

Before Veronica was born in September 2009, her birth mother (who is not Indian) gave her up to Matt and Melanie Capobianco, a couple who wanted to adopt her. Veronica?s biological father, Dusten Brown, also gave up his parental rights. But Brown says he never would have done so if he?d realized that Veronica?s birth mother didn?t plan to raise her. In January 2010, he tried to stop the adoption proceedings. The Cherokee Nation entered the case on his side.

That stopped the adoption in its tracks, because the Indian Child Welfare Act prevents ?involuntary termination? of an Indian parent?s rights without a showing that serious harm is likely to come to the child from ?continued custody.? Were Brown?s parental rights terminated involuntarily? No, he changed his mind. Justice Samuel Alito?s ruling for a majority of five, however, turns on that second phrase ?continued custody.? Since Brown never had custody at all, he shouldn?t have been able to invoke ICWA to block Veronica?s adoption, Alito said. The dissent, by Justice Sonia Sotomayor (joined by Kagan, Ginsburg, and Scalia) accuses Alito of misreading the law because he is concerned that it makes Indian children harder to place in adoptive homes, even though that is ICWA?s intent.

But what law is worth turning a child into a legal and political football, thrown back and forth from infancy to toddlerhood to preschool? The wisest expert I know on adoption law, Joan Heifetz Hollinger of UC?Berkeley Law School, is cited twice by Sotomayor, but Hollinger thinks that Alito got the law right. Or at least, more right, since that?s all that?s really possible in this case. The problem is that by the time the South Carolina courts held a trial to decide who should raise Veronica, she?d been living with the Capobiancos for two years. That is far too old to take a child from the parents she knows. Rule of thumb: If your gut tells you something will hurt a child, the law should stop it from happening.

Alito?s reading of ICWA respects the fundamental purpose of the Indian Child Welfare Act. This law is about protecting Indian families. ?The law shouldn?t be read as giving hyped up protections to birth parents,? Hollinger told me. ?Those protections are for parents who had a life with their child. In that sense, Alito?s decision is the correct reading of statute and it saves the core of ICWA?as it should.?

Hollinger says that if she could turn back the clock, she would want the South Carolina judge to lock the Capobiancos and Brown in a room together, when Veronica was about 5 months old and the matter of Brown?s tribal membership first surfaced, to figure out what would be best for her. ?Maybe the adoption goes through, and the court orders visitation with father or grandparents,? Hollinger said. ?Or maybe the adoption is not allowed, but the adoptive parents receive guardianship.? In other words, you push all the adults involved to put the interests of Veronica first. That is what adoption law does in just about every other circumstance: It treats the best interests of the child as paramount. That is the right standard. Not the best interests of the Cherokee as a tribe. That has to come second.

What is in Veronica?s best interest now, given that she has been in her father?s custody for almost a year and a half? I have no idea, and I?m glad I?m not the South Carolina judge who will have to make that searing decision. ?You can?t determine it based on a statutory ruling or an abstract finding? Hollinger said. ?You have a living human being here.?

Vitamin D improves mood and blood pressure in women with diabetes

June 25, 2013 ? In women who have type 2 diabetes and show signs of depression, vitamin D supplements significantly lowered blood pressure and improved their moods, according to a pilot study at Loyola University Chicago Niehoff School of Nursing.

Vitamin D even helped the women lose a few pounds.

The study was presented at the American Diabetes Association 73rd Scientific Sessions in Chicago.

"Vitamin D supplementation potentially is an easy and cost-effective therapy, with minimal side effects," said Sue M. Penckofer, PhD, RN, lead author of the study and a professor in the Niehoff School of Nursing. "Larger, randomized controlled trials are needed to determine the impact of vitamin D supplementation on depression and major cardiovascular risk factors among women with Type 2 diabetes."

Penckofer recently received a four-year, $1.49 million grant from the National Institute of Nursing Research at the National Institutes of Health to do such a study. Penckofer and her Loyola co-investigators plan to enroll 180 women who have type 2 diabetes, symptoms of depression and insufficient levels of vitamin D. Women will be randomly assigned to receive either a weekly vitamin D supplementation (50,000 International Units) or a matching weekly placebo for six months. The study is titled "Can the Sunshine Vitamin Improve Mood and Self Management in Women with Diabetes?

About 1 in 10 people in the United States has diabetes, and the incidence is projected to increase to 1 in 4 persons by 2050. Women with type 2 diabetes have worse outcomes than men. The reason may be due to depression, which affects more than 25 percent of women with diabetes. Depression impairs a patient's ability to manage her disease by eating right, exercising, taking medications, etc.

Many Americans do not get enough vitamin D, and people with diabetes are at especially high risk for vitamin D insufficiency or deficiency. Reasons include limited intake of foods high in vitamin D, obesity, lack of sun exposure and genetic variations.

The pilot study included 46 women who were an average age of 55 years, had diabetes an average of 8 years and insufficient blood levels of vitamin D (18 ng/ml). They took a weekly dose (50,000 International Units) of vitamin D. (By comparison, the recommended dietary allowance for women 51 to 70 years is 600 IU per day.)

After six months, their vitamin D blood levels reached sufficient levels (average 38 ng/ml) and their moods improved significantly. For example, in a 20-question depression symptom survey, scores decreased from 26.8 at the beginning of the study (indicating moderate depression) to 12.2 at six months (indicating no depression. (The depression scale ranges from 0 to 60, with higher numbers indicating more symptoms of depression.)

Blood pressure also improved, with the upper number decreasing from 140.4 mm Hg to 132.5 mm Hg. And their weight dropped from an average of 226.1 pounds to 223.6 pounds.

Penckofer is internationally known for her research on vitamin D, diabetes and depression. In October, she will be inducted as a Fellow in the American Academy of Nursing for her scientific contributions in improving the health and quality of life of women with chronic disease. And she recently was appointed as the first nurse researcher to the Chicago Diabetes Center for Translational Research.

The High Performance GeoComputing Laboratory (HPGeoC) at the San Diego Supercomputer Center (SDSC), an organized research unit at the University of California, San Diego, was named a winner of the HPC Innovation Excellence Award by the International Data Corporation (IDC) for developing a highly-scalable computer code that promises to dramatically cut both research times and energy costs in simulating seismic hazards throughout California and elsewhere.

The announcement of the award's recipients came during the ISC'13 supercomputing industry conference in Leipzig, Germany. The award recognizes "noteworthy achievements by users of high performance computing (HPC) technologies", particularly "scientific success stories involving HPC."

"We are grateful to IDC for this award which recognizes our efforts to speed regional earthquake simulations for use in earthquake engineering and disaster management as part of a larger computational effort coordinated by the Southern California Earthquake Center (SCEC)," said Yifeng Cui, a computational scientist at SDSC and the leader of the HPGeoC lab, jointly funded by SCEC.

The IDC award cites Cui's team for the development of a highly scalable and efficient code -- using GPUs (graphical processing units) as opposed to CPUs, or central processing units that accelerate a widely-used wave propagation code called AWP-ODC, which stands for Anelastic Wave Propagation by Olsen, Day, and Cui (named for Kim Olsen and Steven Day, geological science professors at San Diego State University and SDSC's Cui). This community code, developed and supported by SCEC, simulates the dynamic rupture and wave propagation that occurs during large-scale earthquakes.

The GPU code was restructured to maximize throughput for reduced time-to-solution, achieving a sustained 2.3 petaflops (quadrillion calculations per second) on a recent benchmark run for a problem twice as large as the previous M8, a magnitude-8 earthquake simulation on the southern San Andreas fault (http://www.sdsc.edu/News%20Items/PR081910_m8_earthqua.html). The Titan supercomputer, based at Oak Ridge National Laboratories and funded by the U.S. Department of Energy, was used for this simulation. Titan is equipped with Cray XK7 systems and NVIDIA's Tesla K20X GPU accelerators.

Moreover, the restructured code resulted in a 110-fold speedup over a heavily optimized CPU code for a key strain tensor calculation critical to probabilistic seismic hazard analysis (PSHA), a standard used by decision-makers to help reduce seismic risk and increase community response to earthquakes.

"The results are expected to take physics-based seismic hazard analysis to a new level with petascale computers, with the potential of saving hundreds of millions of core-hours of computing time," said Cui.

Also contributing to the code's development was Jun Zhou and Efecan Poyraz, graduate students of Electrical and Computer Engineering (ECE) with the Jacobs School of Engineering at UC San Diego; Dong Ju Choi, a computational scientist at SDSC; and Clark Guest, associate professor of ECE.

WASHINGTON (AP) ? Edward Snowden, the former government contractor who says he revealed that the National Security Agency collects Americans' phone records and Internet data from U.S. communication companies, now faces charges of espionage and theft of government property.

Snowden is believed to be in Hong Kong, which could complicate efforts to bring him to a U.S. federal court to answer charges that he engaged in unauthorized communication of national defense information and willful communication of classified communications intelligence information.

In addition to those charges, both brought under the Espionage Act, the government charged Snowden with theft of government property. Each crime carries a maximum sentence of 10 years in prison.

Hong Kong was silent Saturday on whether Snowden should be extradited to the United States now that he has been charged, but some of Hong Kong's legislators said the decision should be up to the Chinese government.

The one-page criminal complaint against Snowden was unsealed Friday in federal court in Alexandria, Va., part of the Eastern District of Virginia where his former employer, government contractor Booz Allen Hamilton, is headquartered, in McLean.

The complaint is dated June 14, five days after Snowden's name first surfaced as the person who had leaked to the news media that the NSA, in two highly classified surveillance programs, gathered telephone and Internet records to ferret out terror plots.

It was unclear Friday whether the U.S. had yet to begin an effort to extradite Snowden from Hong Kong. He could contest extradition on grounds of political persecution. In general, the extradition agreement between the U.S. and Hong Kong excepts political offenses from the obligation to turn over a person. Hong Kong could consider the charges under the Espionage Act political crimes.

Hong Kong had no immediate reaction to word of the charges against Snowden.

The Obama administration has now used the Espionage Act in seven criminal cases in an unprecedented effort to stem leaks. In one of them, Army Pfc. Bradley Manning acknowledged he sent more than 700,000 battlefield reports, diplomatic cables and other materials to the anti-secrecy website WikiLeaks. His military trial is underway.

Sen. Bill Nelson, D-Fla., a member of the Senate Armed Services Committee, welcomed the charges against Snowden.

"I've always thought this was a treasonous act," he said in a statement. "I hope Hong Kong's government will take him into custody and extradite him to the U.S."

But the Government Accountability Project, a whistle-blower advocacy group, said Snowden should be shielded from prosecution by whistle-blower protection laws.

"He disclosed information about a secret program that he reasonably believed to be illegal, and his actions alone brought about the long-overdue national debate about the proper balance between privacy and civil liberties, on the one hand, and national security on the other," the group said in a statement.

Michael di Pretoro, a retired 30-year veteran with the FBI who served from 1990 to 1994 as the legal liaison officer at the American consulate in Hong Kong, said "relations between U.S. and Hong Kong law enforcement personnel are historically quite good."

"In my time, I felt the degree of cooperation was outstanding to the extent that I almost felt I was in an FBI field office," di Pretoro said.

The U.S. and Hong Kong have a standing agreement on the surrender of fugitives. However, Snowden's appeal rights could drag out any extradition proceeding.

The success or failure of any extradition proceeding depends on what the suspect is charged with under U.S. law and how it corresponds to Hong Kong law under the treaty. In order for Hong Kong officials to honor the extradition request, they have to have some applicable statute under their law that corresponds with a violation of U.S. law.

Hong Kong lawmakers said Saturday that the Chinese government should make the final decision on whether Snowden should be extradited to the United States.

Outspoken legislator Leung Kwok-hung said Beijing should instruct Hong Kong to protect Snowden from extradition before his case gets dragged through the court system.

Leung urged the people of Hong Kong to "take to the streets to protect Snowden."

In Iceland, a business executive said Friday that a private plane was on standby to transport Snowden from Hong Kong to Iceland, although Iceland's government says it has not received an asylum request from Snowden.

Business executive Olafur Vignir Sigurvinsson said he has been in contact with someone representing Snowden and has not spoken to the American himself. Private donations are being collected to pay for the flight, he said.

"There are a number of people that are interested in freedom of speech and recognize the importance of knowing who is spying on us," Sigurvinsson said. "We are people that care about privacy."

Disclosure of the criminal complaint came as President Barack Obama held his first meeting with a privacy and civil liberties board and as his intelligence chief sought ways to help Americans understand more about sweeping government surveillance efforts exposed by Snowden.

The five members of the little-known Privacy and Civil Liberties Oversight Board met with Obama for an hour in the White House Situation Room, questioning the president on the two NSA programs that have stoked controversy.

One program collects billions of U.S. phone records. The second gathers audio, video, email, photographic and Internet search usage of foreign nationals overseas, and probably some Americans in the process, who use major Internet service providers, such as Microsoft, Google, Apple, and Yahoo.
